RESOLUTION NO 2025-0612-1 REQUESTING COLLECTION OF CHARGES ON COUNTY TAX ROLL - REVIEW

A RESOLUTION OF THE QUINCY FIRE PROTECTION DISTRICT REQUESTING COLLECTION OF CHARGES ON THE COUNTY TAX ROLL

WHEREAS, the Quincy Fire Protection District (hereinafter referred to as “District”) has the authority, pursuant to Health and Safety Code section 13899, to impose fees, charges, or assessments for services rendered or for regulatory purposes; and

WHEREAS, the District requests the County of Plumas to collect such lawful fees, assessments, or charges on the County tax rolls as authorized by law and as itemized in the schedule of charges attached hereto; and

WHEREAS, the County of Plumas requires, as a condition of such collection, that the District warrant the legality of said fees, assessments, or charges and agree to defend and indemnify the County from any and all legal challenges related thereto;

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Quincy Fire Protection District as follows:

1.       Request for Collection

The District hereby formally requests the Plumas County Auditor-Controller to collect on the County tax roll, in accordance with Government Code sections 29304 and 51800, those taxes, fees, assessments, and/or charges imposed by the District and attached hereto.

2.       Compliance with Law

The District warrants that the charges imposed and submitted for collection comply with all applicable provisions of state law, including but not limited to Articles XIIIC and XIIID of the California Constitution (Proposition 218), as applicable.

3.       Release of County Liability

The District does hereby release and discharge the County of Plumas and its officers, agents, and employees from any and all claims, demands, liabilities, costs, expenses, damages, causes of action, or judgments that may arise as a result of the County’s collection of said District-imposed taxes, assessments, fees, and/or charges.

4.       Indemnification

The District shall defend, indemnify, and hold harmless the County of Plumas and its officers, agents, and employees (“Indemnified Parties”) from any and all claims, demands, liabilities, costs, expenses, damages, causes of action, or judgments that may arise either from:


- The County’s collection of the District’s taxes, assessments, fees, or charges, or
- The District’s establishment, imposition, or administration of such taxes, assessments, fees, or charges.
In the event a judgment is entered against any of the Indemnified Parties in connection with such collection, the County may offset the amount of said judgment from any funds collected on behalf of the District, including property taxes.

5.       Public Inquiries

The District agrees that its officers, agents, and employees shall respond to inquiries or complaints directed to the District regarding said charges and shall not refer such individuals to County personnel for response.

6.       County Collection Costs

The District agrees to pay reasonable administrative costs and service charges as established by the County for placing and collecting the District’s taxes, assessments, fees, or charges on the tax roll, in accordance with Government Code sections 29304 and 51800.

7.       Administrative Cost for Billing Services

For the billing and collection of direct charges, the Plumas County Auditor-Controller shall collect an administrative fee of $2.50 per parcel per fiscal year, which shall be billed as a separate line item on the property tax bill, as reimbursement for billing-related administrative costs.
